General terms and conditions of sale

Terms applied by Aquaforma S.r.l. to product purchases and installation services, for consumer and business customers. The version published on this page prevails.
1. Purpose and scope
These terms govern the sale of furniture, furnishing accessories, bathroom furniture, swimming pools, accessories and related installation services by Aquaforma S.r.l., Viale Europa 46, 24048 Treviolo (BG), VAT 04852690165 (hereinafter the “Seller”). They apply both to consumers (individuals buying for purposes unrelated to their business) and to professionals and companies. Any differing customer terms apply only if accepted in writing by the Seller.
2. Quotes
Quotes are valid for 30 days from the stated date, unless otherwise indicated in writing, and do not bind the Seller until order confirmation. Prices are VAT excluded, unless stated otherwise. Images, measurements and descriptions are indicative, with normal manufacturing tolerances.
3. Orders and conclusion of the contract
The contract is concluded with written acceptance of the quote (signature or email confirmation) and payment of the agreed deposit, normally 30% unless agreed otherwise; the deposit counts as confirmatory earnest (Art. 1385 of the Italian Civil Code). Later changes to the order may entail price and timing variations.
4. Payments
Balance before delivery or installation, unless agreed otherwise in writing. Accepted means: bank transfer and other traceable instruments; cash only within legal limits. In case of delay, professionals incur late-payment interest under Legislative Decree 231/2002; consumers incur statutory interest. Non-payment entitles the Seller to suspend ongoing deliveries and installations.
5. Delivery
Delivery times are indicative, unless an essential deadline is agreed in writing. Delivery is normally at street level, unless agreed otherwise; carrying upstairs, transport to hard-to-reach areas and waiting beyond the agreed times may be charged. On delivery the customer checks packages and quantities and immediately reports any damage or shortages in writing on the delivery note, under penalty of forfeiture.
6. Installation
Where included, installation covers labour and whatever is detailed in the offer. Masonry, plumbing and electrical preparations, permits, grid connections and disposal of old furniture remain the customer's responsibility unless agreed otherwise. The customer guarantees accessibility and practicability of the premises on the agreed dates.
7. Pools and tailor-made products
Surveys and measurements must be confirmed by the customer before production; tailor-made furniture and cut-to-size liners/structures cannot be returned. Excavation, backfilling, ground suitability, building and landscape authorisations, water supply and chemical treatment are the customer's responsibility unless agreed otherwise. Technical installation tolerances and slight colour differences from samples and displays do not constitute a defect.
8. Retention of title
Goods remain the Seller's property until the price is paid in full (Art. 1523 of the Italian Civil Code). The customer may not resell, pledge or remove them before payment without written consent.
9. Consumer right of withdrawal
For contracts concluded off-premises or at a distance, consumers may withdraw within 14 days of delivery, by written notice to info@aquaforma.it, subject to statutory exclusions: in particular, goods made to measure or personalised (Art. 59(c) of the Consumer Code) cannot be returned. The customer returns the goods intact at their own expense within 14 days of withdrawal; the Seller refunds what was collected within 14 days, withholding any loss of value from use beyond normal testing.
10. Warranties
Consumers benefit from the 24-month legal conformity warranty from delivery (Arts. 128–135 of the Consumer Code), with defects to be reported within 2 months of discovery. Professionals benefit from the warranty against defects under Art. 1490 of the Civil Code, to be reported within 8 days of discovery with action within 1 year of delivery. Normal wear, damage from neglect or misuse, incorrect chemical water treatment, installations or modifications by third parties, and consumables are excluded.
11. Complaints and support
Complaints and support requests go to info@aquaforma.it or 035 1977 5152, stating the document number and a description with photos of the issue. The Seller normally replies within 5 business days.
12. Privacy
Customer data is processed to perform the contract and meet legal obligations, under the privacy policy published on this site's Privacy page.
13. Applicable law and jurisdiction
Italian law applies. For consumers, the court of their residence or domicile has jurisdiction; for other customers, the Court of Treviolo.
